Direitos Fundamentais à intimidade, à vida privada, à honra e à imagem (art 5º, X da CF): alcance e substrato fático da norma constitucional (intervenção estatal potencialmente violadora)

RESUMO

O presente artigo vai perseguir o precípuo propósito de investigar as condições jurídicas para a correta interpretação e aplicação do art. 5º, X da CF. No primeiro tópico, a atenção volta-se à interpretação dos dados normativos fundamentais do parâmetro jurídico-constitucional do art. 5º, X da CF, com o esclarecimento a respeito do sistema de direitos fundamentais de personalidade, tal qual previsto pelo constituinte no art. 5º, X da CF. No segundo tópico, os esforços da pesquisa recaem sobre a classificação da categoria de direito fundamental, à qual pertencem os direitos fundamentais de personalidade em pauta. Segue-se a análise de outros elementos jurídico-dogmáticos imprescindíveis à correta interpretação e aplicação do art. 5º, X da CF. No terceiro tópico, definir-se-á o bem jurídico-constitucional, mais precisamente o conteúdo abrangido pela norma definidora do direito fundamental em pauta, que se convencionou chamar da dogmática da área ou âmbito de proteção normativa do art. 5º, X da CF. Nesse sentido, investiga-se o alcance específico de sua área de proteção e elencam-se as típicas intervenções estatais nela, as quais sejam potencialmente violadoras do referido direito fundamental.

ABSTRACT

This article aims to investigate the legal conditions for the correct interpretation and application of the article 5, section 10 of the Federal Constitution (FC). Firstly, the author draws the attention to the interpretation of the fundamental normative data of the constitutional parameter of the article 5(10) of the FC,clarifying on the fundamental rights of personality, as enclosed in the
aforementioned article. Secondly, the study focuses on the category of fundamental right to which belong the fundamental rights of personality discussed in the present article. The author also analyses other legal-dogmatic elements indispensable for
the correct interpretation and application of article 5(10) of the FC. Then, the article defines the legal-constitutional rights and, more precisely, the standard defining the fundamental right aforementioned, so-called the dogmatics or the scope of
normative protection of article 5(10) of the FC. Finally, the study investigates the specific scope of protection and list the typical State interventions in it, which are potentially harmful to the aforesaid fundamental right.
